Flourish & Flo (ABN 92 421 845 527) ("we", "us" or the "Business”) operated by Chloe Barisic (“we”, “us”, “our”).

By booking a session, attending an event, or purchasing a product (including downloads), you confirm that you have read, understood, and agree to these Terms & Conditions, including the Waiver of Liability, Payment & Rescheduling Policy, and Cancellation & Refund Policies below.

1. Services Covered

These terms apply to Breathwork, Remedial/Integrative Massage, Reiki/Energy Alignment, Blended Journeys, Couples/Group sessions, courses/workshops, pop-up events, and digital products (e.g., guided downloads, recordings).

2. Informed Consent & Nature of Services

Our services are supportive, complementary wellbeing practices and do not replace medical, psychological, physiotherapy, or allied health care.

We do not diagnose, treat, or cure medical conditions. Please seek guidance from your GP/specialist for any concerns.

Breathwork may involve altered breathing patterns and emotional release; Remedial Massage involves hands-on touch; Reiki/energy work involves light or no touch.

You may withdraw consent for touch or any process at any time; please communicate clearly during your session.

3. Health Declarations & Medical Clearance

By proceeding, you confirm that:

- You are fit to participate, or have obtained medical clearance if you have (including but not limited to): cardiovascular disease, respiratory issues (e.g., COPD, severe asthma), uncontrolled high/low blood pressure, epilepsy/seizure history, recent surgery or injury, severe mental health conditions (e.g., psychosis), osteoporosis, glaucoma, retinal detachment, or any condition that could be aggravated by breathwork/massage/energy work.

- You will inform us of pregnancy, postpartum status, implanted devices, acute injuries, communicable illnesses, medications or substances that may affect your involvement.

- You will not participate under the influence of alcohol or unlawful substances, and will follow all reasonable instructions for your safety.

4. Assumption of Risk

You understand and accept that participation may involve inherent risks (including but not limited to physical discomfort, muscular soreness, emotional release, breathwork-related light-headedness, or rare adverse responses).
You voluntarily assume all such risks arising from your participation.

5. Waiver, Release & Indemnity (to the extent permitted by law)

To the maximum extent permitted by Australian law, you:

- Release and hold harmless Flourish & Flo, its owners, employees, landlords, contractors, and venue partners from any and all liability, loss, claim, or demand for personal injury, illness, psychological injury, property damage, or death that may arise from participation, including where caused by negligence, except where liability cannot be excluded under the Australian Consumer Law (ACL).

- Indemnify us against any claims, losses, or costs arising from your breach of these terms or your participation.

Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any non-excludable consumer guarantees under the ACL. Where liability cannot be excluded but may be limited, our liability is limited to re-supply of services or refund of the service cost, at our election.

6. Consent to Touch & Professional Boundaries

Massage and some energy practices involve consensual touch. We will explain the approach and check consent.

You may decline or modify any technique at any time. We maintain professional boundaries at all times.

All services are strictly professional and non-sexual.

Any behaviour that is sexual, suggestive, harassing, or otherwise inappropriate—verbal or physical—will not be tolerated.

Sessions will be immediately terminated if such conduct occurs, and full payment will be retained.

Clients agree to maintain respectful, non-sexual boundaries at all times.

7. Group Events, Courses & Venues

You agree to follow all venue rules and our safety instructions.

Minimum/maximum numbers may apply; events may be rescheduled if minimums are not met (see Cancellation Policy Below).

8. Digital Products & Recordings

Where you purchase downloads or course materials, they are for personal use only and may not be copied, shared, or re-sold.

Unless otherwise stated, no therapeutic outcomes are guaranteed; results vary.

9. Payment & Rescheduling Policy (1:1 and Private Group Bookings and All Types of Services/Products Purchased)

The total exchange includes a 100% non-refundable deposit.

Rescheduling: Provide minimum 12 hours’ notice to have your payment transferred as a credit toward a new date.

Within 12 hours or no-show/no contact: The full payment is retained to cover your booking and preparation time.

To cancel or reschedule, email [email protected] with your name and appointment time.

If either you or Chloe must re-book due to illness/emergency within 24 hours, your appointment will be re-scheduled as a priority within existing availability.

10. Cancellation & Refund Policy (Public Group Sessions & Exclusive Events)

All ticket sales are final: no refunds or credits after purchase.

Can’t attend? You may gift/transfer your ticket to another person by confirming their details via text or email at least 4 hours before the event.

Minimum numbers: Most events require 4 participants (max 8). If an event cannot proceed, you will be contacted no later than 3 days prior and offered alternative dates/credit.

Age: All are welcome; minimum age 16+ unless otherwise specified. Some events are held for specific groups of people and ages.

A confirmation email is sent after booking. If you don’t receive it within 1 hour, contact 0481 247 959 or [email protected].

11. Travel & Set-Up Contribution (In-Home Services)

$50 travel & setup applies within 10km of Adelaide CBD (additional costs may apply beyond this).

This contribution is waived for in-home bookings of 2+ people or when a Blended Journey is booked.

12. Gift Cards & Vouchers

Flourish & Flo gift cards/vouchers do not expire.

If prices rise or a service is discontinued, your voucher will be honoured as credit at its original purchase valuetoward any available service/product.

Non-refundable; transferable unless otherwise noted.

13. Privacy & Confidentiality

Flourish & Flo respects the confidentiality of every client and treats all information shared during sessions as strictly private. Anything expressed, discussed, or released—whether spoken, written, or experienced energetically—will not be disclosed to any third party without your written consent, except where required by law (for example, if there is a serious risk of harm to yourself or others or if disclosure is mandated by a court order). Only minimal records, such as appointment times and basic treatment details, are maintained for professional and insurance purposes and are stored securely in compliance with the Australian Privacy Act 1988 (Cth). Any electronic records are protected by password security and accessed solely by Flourish & Flo for administrative or legal requirements.

We collect personal information only as reasonably necessary to deliver services, administer bookings, and meet legal obligations. For payments processed by third-party gateways (e.g., PayPal, Afterpay, Zip, Klarna), we do not receive your full payment details—only order/contact information needed for fulfilment. 14. Fitness to Participate & Emergency Care

Please arrive well-hydrated, fed appropriately, and disclose any conditions that may affect your session.

In an emergency, you authorise us to seek medical assistance on your behalf and you accept responsibility for any associated costs.

15. Minors

Clients under 18 require parent/guardian consent and, for some services, a guardian present on site (as advised on booking).

16. Changes to Terms

We may update these terms at any time; updates take effect when posted on our website with a new “Last updated” date.

17. Governing Law

These terms are governed by the laws of South Australia, Australia. You agree to the exclusive jurisdiction of SA courts.

By clicking “I Agree,” completing a purchase/booking, or attending a session/event, you acknowledge and accept these Terms & Conditions and the Waiver of Liability.
